Where calls are recorded or transcribed, additional disclosures and consent requirements may apply.
3. Sources of Personal Information
We may obtain personal information from:
- Individuals who provide information directly.
- Customers who upload or connect their databases.
- Authorized CRM and business integrations.
- Publicly available property and government records.
- Licensed property-data providers.
- Third-party analytics and technology providers.
- Interactions with websites, property reports and communications.
Information being publicly available does not automatically mean it may be used for every purpose.
We process personal information only where an applicable legal basis, consent, authorization or other lawful permission exists.
4. How We Use Personal Information
We may use personal information for the following purposes:
- Providing and operating Seller IQ.
- Creating and maintaining customer accounts.
- Enriching authorized customer databases.
- Producing property insights and valuation estimates.
- Generating predictive seller-intent indicators.
- Supporting homeowner engagement tools.
- Facilitating customer-authorized communications.
- Operating CRM integrations.
- Providing technical support.
- Processing subscriptions and payments.
- Detecting fraud, abuse and security threats.
- Maintaining service reliability, security and performance.
- Complying with applicable legal obligations.
Identifiable customer, lead and communication information is used to deliver, support and secure the Services and meet legal obligations. It is not used for unrelated advertising or shared-model training. We may use lawfully aggregated and de-identified information to measure performance and improve the Services only where it cannot reasonably identify an individual or customer, and we do not attempt re-identification.
We do not guarantee the accuracy of property estimates, financial indicators or predictive seller-intent scores.
5. Artificial Intelligence and Predictive Analytics
Seller IQ uses artificial intelligence, automated analysis and statistical methods to identify patterns that may indicate potential real estate selling opportunities.
Depending on data availability, these systems may evaluate:
- Property ownership duration.
- Estimated property value and equity.
- Mortgage-related indicators.
- Local market and neighborhood activity.
- Property transaction history.
- Homeowner engagement with property reports.
These indicators may be combined to generate predictive seller-intent scores.
A predictive score does not establish a homeowner’s actual intention to sell, financial condition or willingness to be contacted.
Scores are intended to support real estate prospecting and professional decision-making.
Seller IQ does not authorize customers to use predictive scores to make decisions about eligibility for credit, insurance, employment, housing or other legally protected opportunities.
We do not use customer databases, lead information, report interactions or communications to train general-purpose or shared AI models. AI providers processing this information on our behalf are not permitted to use it for their independent model training. Using an AI model to generate an authorized report, score or communication is processing to deliver the service; it does not authorize training that model on the information.
Where applicable law provides rights concerning automated decision-making, individuals may exercise those rights as described in this Policy.
6. Customer Responsibilities and Data Processing Roles
Customers may act as independent controllers or businesses responsible for determining the purposes and lawful basis of processing their contact databases.
Mod AI Inc. may act as a service provider or processor when handling personal information on a customer’s documented instructions.
For certain activities, including account administration, billing, security and legal compliance, Mod AI Inc. may independently determine how personal information is processed.
Customers are responsible for providing legally required notices and obtaining any necessary consent or other lawful authorization for their marketing and communications.
Schedule A of the Terms and Conditions sets out our obligations when processing customer personal information on the customer’s behalf, including permitted processing, confidentiality, subprocessors, security incidents, assistance with privacy rights, transfers and deletion. A separately agreed data-processing agreement may also apply. Actual legal roles depend on the processing performed; customer responsibilities do not remove Mod AI Inc.’s own obligations.
7. Marketing Communications and Consent
Seller IQ may enable customers to send email communications, property reports and other marketing materials to homeowners and contacts.
Customers are responsible for ensuring that their communications comply with applicable laws, including Canada’s Anti-Spam Legislation (CASL), the United States CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA) and relevant privacy and telemarketing regulations.
Where required, communications must include appropriate sender identification, disclosures and unsubscribe mechanisms.
Individuals may opt out of marketing communications using available unsubscribe links or by contacting the sender.
We apply unsubscribe and other opt-out requests received through the Platform to the affected communications within applicable legal time limits. Customers must also communicate relevant preferences recorded in their CRM or other systems; synchronization depends on the integration’s supported functions. Opening a report, clicking a link or receiving a seller-intent score does not by itself establish permission for marketing contact.
Opting out of marketing does not necessarily prevent essential transactional, security or legally required communications. These communications must not be used to evade an opt-out by including unrelated marketing.
Mod AI Inc. may also send its own service-related communications to customers.
8. AI Calling and Call Information
Where AI calling features are purchased and enabled, Seller IQ may process telephone numbers, call metadata and, where applicable, call recordings or transcripts.
Customers are responsible for obtaining any legally required authorization for automated calls, AI-generated voices and call recording.
Recording and disclosure requirements vary by jurisdiction.
Mod AI Inc. may use authorized telecommunications and AI service providers to deliver these features.
Call-related information will be retained and processed according to applicable law, service configuration and contractual requirements.
10. International Data Transfers
Mod AI Inc. is based in Ontario, Canada, and provides Seller IQ services to supported markets in the United States and Canada.
Personal information may be processed or stored by authorized service providers operating in Canada, the United States or other jurisdictions where permitted by applicable law.
Information processed outside an individual’s home jurisdiction may be subject to different privacy laws and lawful access requirements.
Where required, we implement appropriate contractual, technical and organizational safeguards for international transfers.
11. Data Security
We use reasonable administrative, technical and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, loss or misuse.
These measures may include:
- Access controls and account authentication.
- Encryption where appropriate.
- Restricted administrative permissions.
- System monitoring and security logging.
- Vendor security reviews.
- Internal data-handling procedures.
No method of electronic transmission or storage can be guaranteed completely secure.
If a security incident occurs, we will investigate, take reasonable containment and remediation steps, and provide notifications required by applicable law. For a confirmed incident affecting personal information processed on a customer’s behalf, we will also notify the customer without undue delay and provide relevant available information and updates under Schedule A of the Terms. Contractual notification does not replace or delay statutory reporting obligations.
12. Data Retention and Deletion
We retain personal information only for the time needed to deliver the Services and fulfil lawful purposes, subject to the specific cancellation and deletion arrangements below.
Cancelling a subscription stops renewal. Unless the customer separately deletes the account, access continues to the end of the paid billing period. New automated campaigns and processing stop when paid access ends, although communications already submitted to an external provider may not be recallable.
If a customer cancels without choosing account deletion, we retain its Customer Data for 90 days after paid subscription access ends. During those 90 days, an authorized account contact may request an export of available customer-supplied data by emailing support@modselleriq.com. Licensed enrichment data and proprietary outputs can be exported only where permitted by applicable licences. This period does not extend paid access or authorize continued campaigns.
After those 90 days, we delete or irreversibly anonymize the Customer Data in active service systems, subject to legally required retention.
An authorized customer may instead select the account-deletion option. Deleting the account immediately deactivates it: access ends, future subscription renewals stop and new automated activity stops. The account can be reactivated within 30 days after deletion. If it is not reactivated within those 30 days, we permanently delete account information and Customer Data from active service systems, except information we are legally required to retain. Customers should export data before deletion; permanently deleted information is no longer available for export.
Permanent deletion from active systems does not mean instantaneous erasure from protected backups. Residual backup copies remain protected and unavailable for routine use until removed through the applicable backup rotation. If a backup is restored, applicable deletion instructions must be reapplied. We instruct subprocessors to delete affected information as required by our agreements and applicable law.
We retain only the billing, tax, legal or regulatory records that applicable law requires. A minimal suppression record may be retained where legally necessary to honour opt-outs; it must not be used to resume marketing.
Deleting a Seller IQ account does not delete information independently held in the customer’s CRM, public records or a third party’s own databases. Individual homeowner rights requests are handled under Sections 14–16 and applicable law; a homeowner’s request is not a request to delete an entire brokerage account.
For questions about retained records or applicable backup retention, contact support@modselleriq.com.
14. Privacy Rights in Canada
Individuals in Canada may have rights under applicable federal and provincial privacy laws, including PIPEDA and relevant provincial legislation.
Depending on the circumstances, these rights may include:
- Requesting access to personal information.
- Requesting correction of inaccurate information.
- Withdrawing consent where applicable, subject to legal or contractual restrictions.
- Requesting information about how personal information is used or disclosed.
- Challenging compliance with applicable privacy obligations.
Additional rights may apply in certain provinces, including Quebec.
Requests may be submitted to support@modselleriq.com.
Where information is controlled by a customer, we may direct the request to that customer or assist them in responding.
15. Privacy Rights in the United States
Residents of certain US states may have additional rights under applicable state privacy laws.
Depending on the jurisdiction, applicable law and the nature of our processing, these may include the right to:
- Know what personal information is collected and processed.
- Access personal information.
- Request correction of inaccurate information.
- Request deletion of eligible personal information.
- Obtain a portable copy of certain information.
- Opt out of qualifying sales, sharing, targeted advertising or certain profiling activities.
- Appeal certain denied privacy requests.
- Exercise privacy rights without unlawful discrimination.
Not all rights apply to every individual or every processing activity.
We will evaluate and respond to verified requests according to applicable legal requirements.
Requests, applicable opt-outs and appeals of a denied request may be submitted to support@modselleriq.com. We will explain the applicable verification and appeal process in our response and honour legally required authorized-agent requests and recognized opt-out signals where applicable. We do not currently sell personal information or share it for targeted or cross-context behavioural advertising.
16. Homeowner Privacy Requests
Homeowners whose information appears within Seller IQ may contact us to ask questions about their personal information or submit an applicable privacy request.
Requests may concern:
- Access to personal information.
- Correction of inaccurate records.
- Deletion where legally required.
- Applicable objections or opt-outs.
- Information about data sources and processing purposes.
Some information may originate from public records or licensed third-party databases.
Removing information from Seller IQ does not necessarily remove the original information from government records, customer-owned systems or independent third-party databases.
Where applicable, we will coordinate with the relevant customer or data provider to address requests.
17. Children's Privacy
Seller IQ is intended for professional real estate business use and is not directed toward children under 18.
We do not knowingly solicit personal information directly from children through our Platform.
If we become aware that personal information has been collected in violation of applicable children’s privacy laws, we will take appropriate action.
18. Third-Party Websites and Services
Seller IQ may contain links to third-party websites or connect with independently operated services.
We are not responsible for the privacy practices of third parties acting independently.
Users should review the applicable privacy policies of those services.
19. Business Transfers and Legal Requirements
We may disclose or transfer personal information in connection with a merger, acquisition, corporate restructuring or sale of business assets, subject to applicable legal requirements and appropriate safeguards.
We may also disclose information where necessary to comply with applicable law, respond to lawful legal processes, protect legal rights or address security threats.
20. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our Services, technology, data practices or applicable law.
The updated Policy will be published on our website with a revised effective date.
We will communicate material changes to affected account holders using their account email or another appropriate channel and obtain any consent required before implementing a new purpose or materially different use. Posting a revised Policy alone does not authorize a new data use or override contractual restrictions or applicable law.
Google user data
When you sign in with Google, Seller IQ asks only for your basic profile (name) and email address. We use them only to create your account and sign you in. We do not use Google user data for advertising, we do not sell it, and we do not let people read it except where needed for security, to comply with the law, or with your permission.
Seller IQ’s use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements.
